Ex-officer files claim against New York state following acquittal in inmate's beating death

Nicholas Kieffer, a former guard at Marcy Correctional Facility who was acquitted of all charges in connection to the beating death of inmate Robert Brooks, has filed a $5 million claim against New York State.

The claim is seeking backpay and damages for malicious prosecution, defamation, negligence in training and more, according to court paperwork obtained by 13WHAM.

Brooks, 43, of Greece, was brutally beaten after his arrival Dec. 9, 2024 at Marcy Correctional Facility. The beating was captured on guards’ body cameras, prompting calls for prison reform. Brooks died the next day.

According to the claim, Brooks became noncompliant when officers escorted him to the infirmary treatment room. Kieffer used OC spray and applied it to the back of Brooks' head and neck area, in accordance with Department of Corrections and Community Supervision policy. The claim also states Kieffer was not one of the officers who assaulted Brooks.

Kieffer and fellow ex-officer Matthew Galliher were acquitted of murder, manslaughter and gang assault in a trial last fall. Kieffer was also acquitted of offering a false instrument for filing. David Kingsley was found guilty of second-degree murder and first-degree manslaughter and was received the maximum sentence Dec. 19 of 25 years to life in prison.

Seven other guards pleaded guilty to manslaughter or lesser charges. One of them, David Walters, was released from prison in December after posting bond pending an appeal of his guilty plea.

The lawsuit accuses the prosecution of furthering the political agenda of Gov. Kathy Hochul and Attorney General Letitia James.
